Frequently asked questions

Do NRIs need to file an income-tax return in India?
Filing is required when taxable Indian income exceeds the basic exemption limit, when claiming a TDS refund, or when specified transactions trigger mandatory filing. Rental income, capital gains and NRO interest are the common sources.
How is sale of property in India taxed for an NRI?
Capital gains are taxable in India and the buyer deducts TDS at non-resident rates on the consideration. A lower/nil deduction certificate can be obtained in advance; repatriation then requires 15CA/CB and FEMA compliance.
Can NRIs claim DTAA relief?
Yes — with a valid Tax Residency Certificate and Form 10F, treaty benefits such as reduced withholding or tax credits can be claimed on Indian income.
